Software User Agreement
Effective Date: July 9th, 2025
This User Agreement (hereinafter referred to as "Agreement") is a legal contract between you (individual or entity) and EnergizeLab (hereinafter referred to as "we") regarding your use of our robot hardware, applications, software, and related online services (hereinafter referred to as "Products and Services").
By using any of our Products and Services, you confirm that you are at least 18 years old or that you are using them with the consent of a parent or guardian, and you agree to be bound by this Agreement.
1. License
Subject to your compliance with all the terms of this Agreement, EnergizeLab grants you a limited, non-exclusive, non-transferable license to use the accompanying software and applications solely for your personal and non-commercial use.
2. Your Account
You need to create an account using your email to access all features. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3. Acceptable Use
You agree not to use our Products and Services in any unlawful or prohibited manner as set forth in this Agreement. In particular, you agree not to:
- Use the cameras, microphones, or communication features of the Products and Services for any form of surveillance, harassment, or invasion of others' privacy.
- Use the Products and Services for any purpose that could endanger your or others’ safety.
- Attempt to bypass any security or access control features of the Products and Services.
- Decompile, reverse-engineer, or attempt to extract the source code of the software.
4. Content, AI, and Third-Party Services
Your Interaction: Our Products and Services allow you to interact through voice, gestures, and other means. You understand and agree that your interaction data (such as voice) may need to be transmitted to third-party service providers like Alibaba Cloud for processing.
AI-Generated Content: The Products and Services may generate replies, divination results, or other AI-driven content. These contents are for entertainment and reference purposes only and do not constitute professional advice. EnergizeLab does not guarantee their accuracy, reliability, or applicability.
5. Intellectual Property
All technologies, software, designs, text, and graphics included in the Products and Services are owned by EnergizeLab or our licensors and are protected by intellectual property laws. This Agreement does not transfer any of those rights to you.
6. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Products and Services are provided on an "as is" and "as available" basis. EnergizeLab does not offer any form of express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the operation of the Products and Services will be uninterrupted or error-free.
7. Limitation of Liability
To the maximum extent permitted by law, EnergizeLab is not liable for any indirect, incidental, special, punitive, or consequential damages (including loss of data, loss of profits, or business interruptions). Our cumulative liability in any circumstance shall not exceed the amount you paid for the Products and Services that caused the liability.
8. Privacy
We process your information in accordance with our EnergizeLab Privacy Policy. That policy explains how we handle data such as camera and voice data and is an integral part of this Agreement.
9. Physical Safety and Use
You acknowledge and agree:
- The Product includes a camera that can be physically covered, and you should use this feature responsibly to protect your privacy.
- You should use the robot in a safe environment and avoid using it in extreme conditions, such as wet or dusty areas.
10. General Terms
Changes to the Agreement: We may update this Agreement from time to time. After a revised version is published, your continued use of the Products and Services constitutes acceptance of the updated terms.
Governing Law: This Agreement is governed by and construed in accordance with the laws of the People's Republic of China.
Termination: You may cease using the Products and Services and close your account at any time. If you violate this Agreement, we may terminate your license, and you must immediately stop using and destroy all related software.
